Host Agreement

1. Relationship to the Terms & Conditions

This Host Agreement supplements, and is incorporated into, Spukkles' Terms & Conditions. By listing a property, accepting a staff role, or otherwise operating an account with a host-level role on Spukkles, you agree to this Host Agreement in addition to the Terms & Conditions and Privacy Policy. Definitions, the general platform overview, acceptable use, intellectual property, limitation of liability, changes-to-terms, and governing-law provisions in the Terms & Conditions apply equally to hosts and are not repeated here except where this Agreement adds or modifies them.

2. Host Eligibility & Identity Verification (KYC)

Before your account can receive payouts, you must complete identity verification (KYC β€” Know Your Customer). This currently requires submitting a valid national ID or passport (front and back) together with the associated ID number, for manual review by our compliance team. Spukkles may approve, reject, or request additional information at its discretion, and may require re-verification if your account details materially change. Staff you invite to a property (cleaners, guards, managers) are assigned by you and do not independently undergo this host-level KYC process.

3. Listing & Property Standards

As a host, you are solely responsible for:

  • The accuracy of your listing β€” pricing, availability, photos, amenities, and house rules β€” at all times.
  • Holding any licence, permit, or registration required by your local laws to operate a short-term rental, and complying with those laws.
  • If you connect a third-party channel or OTA to synchronise availability, keeping that connection accurate and promptly resolving any conflicting bookings it produces β€” Spukkles is not liable for double-bookings arising from a third-party channel's own outage or delay.

4. Payments & Settlement

Guest payments you receive are collected and held pending settlement under the settlement lifecycle described in the Terms & Conditions, Β§3 (Payments & Settlement). The sections below describe how your share of those funds moves once released.

5. Settlements & Payouts

Released funds accumulate in your Spukkles host wallet. You may request a payout at any time subject to the following:

  • Payouts are processed via the destination method configured in your Settlement Preferences: M-Pesa (mobile money) or bank transfer.
  • A daily automated sweep may be enabled; when active it will disburse your available wallet balance to your configured destination every day at 12:00 PM server time.
  • A minimum withdrawal amount of KES 100 applies. Manual payout requests require one-time-passcode (OTP) verification. Each destination method also carries its own per-transaction and daily transfer caps (currently: M-Pesa β€” KES 250,000 / KES 500,000; bank transfer β€” KES 500,000 / KES 2,500,000), which Spukkles may adjust at its discretion and which are also subject to the limits imposed by the underlying provider.
  • Spukkles is not liable for delays caused by third-party payment gateways, bank processing times, or incorrect destination details provided by you.
  • Settlement statements are available in your dashboard and provide an auditable record of all gross amounts, platform fees, taxes, and net payouts.

6. Platform Fees & Commissions

Spukkles charges a platform commission of 5% on the gross value of each confirmed booking (this rate may be set individually by country; where no country-specific rate is configured, the global default shown above applies). This commission is deducted before funds are placed in your settlement wallet; your settlement balance reflects the net amount after commission. Additional fees may include:

  • Payment Processing: a processing fee (currently 1.5% of transaction value) applies in addition to any third-party gateway costs; both are disclosed in the Platform Fees section of your dashboard.
  • Cancellation Fees: under your property's selected cancellation policy (Flexible, Moderate, or Strict), the guest's refund percentage varies by how far in advance they cancel β€” see the Terms & Conditions, Β§4 for the exact tiers. Regardless of the refund percentage applied, Spukkles retains a cancellation processing fee from the booking value: currently 3% under a Flexible policy, or 5% under Moderate or Strict. All cancellation fees are recorded in the platform fee audit trail.
  • Listing Promotion: optional paid promotion services (currently $75 per featured listing, where enabled for your account) are subject to separate pricing disclosed at purchase.
  • Marketing & Service Charges: a monthly marketing contribution and/or service charge may apply depending on your plan, disclosed in the Platform Fees section of your dashboard.

Fee configurations are managed by platform administrators and may be updated with 30 days' notice. Current rates are always visible in the Platform Fees section of your dashboard.

7. Taxes & Compliance

You are solely responsible for determining and remitting any taxes applicable to your rental income under the laws of your jurisdiction. Spukkles provides tax assistance tools β€” including VAT, Tourism Tax, and Withholding Tax estimates β€” for informational purposes only. These estimates:

  • Are calculated on the gross booking value using default rates modeled on Kenyan tax bands (VAT 16%, Tourism Levy 2%, Withholding Tax 3%). These default rates are currently applied uniformly regardless of your registered country β€” if you operate outside Kenya, you are responsible for independently determining and applying the correct rates for your own jurisdiction rather than relying on the figures shown.
  • Are not a substitute for advice from a qualified tax professional.
  • Do not constitute tax filing, remittance, or any representation that the rates shown are accurate for your specific circumstances.

Hosts operating in jurisdictions that require Spukkles to collect and remit taxes on their behalf may be subject to additional terms disclosed separately. Tax invoices and records are available in your dashboard for up to 7 years.

8. Wallet & Ledger

Your Spukkles host wallet maintains an immutable ledger of all credits and debits. The canonical wallet balance is derived from the sum of all credit entries minus debit entries β€” no balance is stored independently, and an automated reconciliation process continuously checks wallets, settlement accounts, and booking records for consistency. You may view your full transaction history in the Transactions section of your dashboard. Spukkles reserves the right to freeze wallet balances pending investigation of suspected fraud, policy violations, or regulatory requirements, with notice provided where lawfully permitted.

9. Dispute Response Obligations

The general dispute and chargeback rules in the Terms & Conditions, Β§5 apply to you as a host. In addition: you must respond to any dispute filed against one of your bookings within 5 business days, providing any evidence requested. Failure to respond within that window may result in the dispute being resolved in the guest's favor by default. Spukkles may hold the funds tied to a booking pending settlement for the duration of an active dispute investigation.

10. Term & Termination

This Agreement remains in effect for as long as you maintain a host-level account or an active listing on Spukkles. Spukkles may suspend or terminate your hosting access for violations of this Agreement or the Terms & Conditions' Acceptable Use section. Termination does not relieve you of obligations that accrued before termination, including outstanding tax responsibilities and any funds already released to or owed by your wallet. Changes to this Agreement follow the same notice process as the Terms & Conditions, Β§10.
